Washington:
Donald Trump urged a federal judge to reconsider two charges of central obstruction in case the former US president illegally tried to overturn his 2020 election defeat, citing a recent US Supreme Court decision that raises the legal issue of these crimes.
Lawyers for Trump, the Republican presidential nominee, will argue in a court process that the Supreme Court's decision requires U.S. District Judge Tanya Chutkan to face charges accusing Trump of corruptly obstructing an official process, a testimony Congress is offering for his defeat to Democrat Joe Biden. Trump is also seeking to dismiss other lawsuits in the impeachment on other grounds.
Trump has pleaded not guilty to four charges accusing him of a multi-faceted conspiracy to prevent vote collection and confirm his electoral defeat.
Trump's argument is based on the Supreme Court's 6-3 decision in June, in which the justices will side with the arguedo felon charged under the same obstruction law and accused of participating in the January 6 Capitol riot in the United States of America.
The court concluded that alleged defendants under the law should be required to compromise the “availability or integrity” of documents or other records related to an official process — or attempt to do so.
The accusation alleges that Trump attempted to disrupt the congressional session by creating fraudulent lists of presidential electors who promised to support him in battleground states he lost and then pressured Vice President Mike Pence to groom those pro-Trump electors when Pence presided.
Trump's lawyers will argue that prosecutors cannot prove that Trump sought to prejudice issues related to the election certification and cannot be held liable for the behavior of protesters who delayed the congressional session.
Today, a day after the promoters detailed their case against Trump, arguing that he survives a separate US Supreme Court ruling on presidential immunity.
